✅ ACCEPTANCE OF TERMS
By completing a purchase, activating service, or using any 9dash9 service, you agree to be bound by these Terms of Service in their entirety. No signature is required — payment constitutes full acceptance.
📋 NO CONTRACTS. MONTH-TO-MONTH.
9dash9 services are provided on a month-to-month basis. No minimum term. No lock-in. No early termination fees. Cancel anytime with 30 days’ written notice.
🛡️ 9dash9 Service Shield — Optional Add-On
The Service Shield is an optional one-time purchase ($65.95 CAD) available at or prior to activation. Where applied, it waives the standard activation fee, covers porting of one (1) existing Canadian number, and provides priority onboarding. The Service Shield is non-refundable and does not create any minimum term commitment. Standard activation and porting fees apply if the Shield has not been purchased.
1. Introduction
These Terms of Service, together with the Acceptable Use Policy, pricing schedule, and any supplemental documents incorporated by reference (collectively, the “Agreement”), constitute a legal agreement between you (“Customer”) and 9dash9 Communication Corp. (“9dash9”) for 9dash9 VoIP Services (“Services”). By completing a purchase or using the Services, you agree to the terms of this Agreement in their entirety.
2. Month-to-Month Service — No Minimum Commitment
9dash9 provides Services on a month-to-month basis only. There are no minimum term commitments, lock-in periods, or early termination fees of any kind. Your service begins on the date 9dash9 successfully processes your payment.
Either party may cancel at any time by providing at least thirty (30) days’ written notice to the other party. Following the effective cancellation date, 9dash9 will refund any prepaid balance within thirty (30) days less any amounts outstanding.
3. Billing and Payment
Services are billed monthly in advance in Canadian Dollars (CAD). By entering into this Agreement, you authorize 9dash9 to charge the payment method on file for all applicable recurring and usage-based fees. All payments are non-refundable except as expressly stated herein. Failure to pay in full may result in suspension of Services.
You are responsible for all inbound and outbound call traffic associated with your account regardless of source or authorization. A late charge of 1.5% per month applies to balances more than thirty (30) days past due. Suspended services will be unavailable until the balance is paid in full.
All prices are exclusive of applicable taxes, fees, and government charges including GST/HST. Pricing is subject to change with thirty (30) days’ notice.
4. Service Distinctions
9dash9 provides VoIP services, not traditional telephone service. The Service is subject to different regulatory treatment and may be affected by events beyond 9dash9’s control including power outages, Internet disruptions, and broadband service failures. 9DASH9 IS NOT RESPONSIBLE FOR ANY THIRD-PARTY PRODUCTS OR SERVICES, OR FOR PROBLEMS IN THE SERVICES CAUSED BY YOUR INTERNET CONNECTION.
5. Emergency Services — 911 Dialing
9dash9’s 911 dialing operates differently than traditional 911. You must register a physical location (“Registered Location”) for each phone line. 9dash9’s only mechanism for routing 911 calls to the correct Public Safety Answering Point (PSAP) is the Registered Location you provide.
YOU ACKNOWLEDGE THAT FAILURE TO MAINTAIN A CURRENT AND CORRECT REGISTERED LOCATION WILL RESULT IN EMERGENCY CALLS BEING ROUTED TO THE INCORRECT EMERGENCY SERVICE PROVIDER.
E911 service will NOT be available in the following circumstances: relocation of equipment without updating your Registered Location; changing or porting numbers without re-registering; Internet connection failure; equipment failure or misconfiguration; loss of electrical power; suspension or termination of service; or network congestion.
You must inform all users of these limitations and affix 9dash9’s provided 911 warning labels to all VoIP equipment. You agree to indemnify and hold harmless 9dash9 from any third-party claims arising from 911 service limitations, misrouting, or outages.
6. Acceptable Use Policy
You agree not to use, and not to allow any end user to use, the Services for any prohibited purpose, including:
- Any illegal, abusive, or fraudulent activity
- Bypassing or disabling any security mechanism
- Denial of service attacks or activities adversely impacting service stability
- Transmitting malicious code, viruses, or harmful programs
- Unsolicited marketing in violation of CASL, TCPA, or comparable laws
- Harassing, libelous, defamatory, or discriminatory communications
- Caller ID spoofing or false identity creation
- Any use not authorized by 9dash9
7. Limitation of Liability
9DASH9 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE SERVICES ARE PROVIDED “AS IS.”
EITHER PARTY’S LIABILITY ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT SHALL BE LIMITED IN AGGREGATE TO THE TOTAL AMOUNTS BILLED FOR SERVICES FOR THE THREE (3) MONTHS PRIOR TO THE ALLEGED BREACH.
8. Force Majeure
9dash9 shall be excused from any delay or failure in performance caused by circumstances beyond its reasonable control, including acts of God, earthquake, fire, flooding, pandemic, epidemic, civil unrest, war, government intervention, embargoes, strikes, labour difficulties, equipment failure, or widespread Internet or infrastructure outages. 9dash9 will use commercially reasonable efforts to restore Services as quickly as practicable.
9. Dispute Resolution
Any disputes arising out of or relating to this Agreement shall be resolved by binding arbitration under the Arbitration Act applicable in the Province of Ontario. A party seeking arbitration must first send a written Notice of Dispute. If no resolution is reached within thirty (30) days, either party may commence arbitration. The arbitrator’s decision is final and binding. Both parties waive the right to a trial by judge or jury.
10. Governing Law
This Agreement is governed by the laws of the Province of Ontario and the laws of Canada applicable therein.
11. General Provisions
No Waiver: Failure to enforce any provision shall not constitute a waiver of that right.
Entire Agreement: This Agreement supersedes all prior agreements between the parties regarding the subject matter herein.
Severability: If any provision is held invalid, the remaining provisions continue in full force.
Survivability: Limitation of liability, indemnification, confidentiality, and dispute resolution provisions survive termination.
Assignment: 9dash9 may assign its rights without notice. Customer may not assign without 9dash9’s written consent.
